Package travel contracts – information to be provided to travellers 

The information in this document shall be provided to the passengers before signing a package travel contract and in the context of booking confirmations.  

Information about travellers’ rights 

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302. Therefore, you will benefit from all EU rights applying to packages. Kautio Oy and Kassiopeia Finland Oy, its company that produces travel along with its subsidiaries, will be fully responsible for the proper performance of the package as a whole. Additionally, Kautio Oy has protection in place to refund your payments in the event that it becomes insolvent. 

Key rights under Directive (EU) 2015/2302: 

– Travellers will receive all essential information about the package before concluding the package travel contract. 

– There is always at least one trader who is liable for the proper performance of all the travel services included in the contract. 

– Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organiser or the travel agent. 

– Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs. 

– The price of the package may only be increased if specific costs rise (for instance, fuel prices) and if expressly provided for in the contract, and in any event no later than 20 days before the start of the package. If the price increase exceeds 8% of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs. 

Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate. 

– Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package. 

– Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee. 

– If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, if services are not performed in accordance with the contract and this substantially affects the performance of the package, and the organiser fails to remedy the problem. 

– Travellers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed. 

– The organiser must provide assistance if the traveller is in difficulty. 

– If the organiser or, in some Member States, the retailer becomes insolvent, payments will be refunded. Kautio Oy has taken out insolvency protection by providing the Finnish Competition and Consumer Authority with a Handelsbanken pledge as a security. Information about the package 

Travel organiser:  

The organiser is Kautio Oy, for which travel services are produced by Kassiopeia Finland Oy and its subsidiaries. Kassiopeia Finland Oy’s contact details: Knitter Business Park, Kutojantie 6–8, FI-02630 Espoo, tel. +358 (0)40 456 2059, e-mail sales@kassiopeia.fi 

Main characteristics of the travel services offered: 

The accommodation, meal and program services and other possible services included in the travel package are defined in more detail in the description of each travel package. These main features apply to all travel packages. The special conditions of each travel package are listed in the description of that travel package. 

Suitability of travel packages for people with reduced mobility: 

Travel packages are not suitable for people with reduced mobility. 

The total price of the travel package and any additional costs and payment terms: 

The price of the travel package is determined at the time of booking based on the currently valid price level and the services chosen by the customer, as well as the room category of the accommodation. The travel package is paid in full when booking. The reservation can be paid with a credit card or online banking credentials. 

Travel documents: 

The passenger must have either a passport, identity card or driver’s license. 

Travel insurance: 

Travellers are not required to have a valid travel insurance policy. That being said, we recommend our customers to take out a travel insurance policy. The organiser is not responsible for any voluntary insurance policies that travellers may need during the travel. The travellers themselves are responsible for their insurance coverage. For this reason, the organiser urges travellers to take out a sufficiently extensive travel insurance policy for person and property, which also covers cancellations. 

The organiser’s obligation to provide assistance: 

The organiser shall, without undue delay, provide travellers who are facing difficulties with information on health services, local authorities, and consular assistance, arrange the opportunity to make distance communications, help travellers make alternative travel arrangements and provide other appropriate assistance. 

The organiser shall be able to charge a reasonable fee for such assistance if the difficulty is caused intentionally by the traveller or through the traveller’s negligence. That fee shall not in any event exceed the actual costs incurred by the organiser. 

Errors and related notifications: 

The organiser’s performance is considered to include an error if 

a) the services or other arrangements entailed in the trip do not match what has been agreed or can be considered to have been agreed, or 

b) the organiser has failed to provide the traveller with the information necessitated by the Act on Travel Service Combinations with regard to the terms applicable to the trip or other matters indicated in the Act, such as the trip content or requisite travel documents, and this can be considered to have impacted the traveller’s decision-making, or 

c) the organiser has neglected its obligation to provide assistance. 

Travellers may not invoke an error after the trip unless they notify the organiser of the error in question within a reasonable time from noticing or being expected to have noticed the error. The organiser or retailer shall be notified as soon as possible of errors that can be rectified during the travel. 

Unless it is necessary to correct the error immediately, the traveller shall set a reasonable time frame for the rectification. The reasonable time frame should be decided with due consideration to the duration, destination and nature of the travel. 

However, what is stated above does not prevent passengers from invoking an error if the organiser or another trader that it has used for assistance in fulfilling the contract has been grossly negligent of proper conduct and values or dishonourable in its actions. 

If the organiser indicates that it will not correct the error or if the rectification is not carried out immediately or within the reasonable time frame set by the traveller, the traveller has the right to rectify the situation independently. In this case, the passenger is entitled to compensation from the organiser for the costs caused by rectifying the error. 

The organiser is entitled to refuse the rectification of an error if it is impossible or would cause unreasonable costs considering the scope of the error and the value of the travel services. Correspondingly, the organiser has the right to refuse to pay unreasonable costs caused by the rectification in the event that the traveller has corrected the error in question independently. 

If the error is not rectified without delay at the cost of the organiser or if the error cannot be rectified, the traveller is entitled to a price reduction corresponding to the significance of the error, unless the organiser can demonstrate that the error is attributable to the traveller. 

However, the traveller is not entitled to a price reduction if the error is minor in significance in relation to the entire contract. 

Transferring a package travel contract to another person: 

Travellers are entitled to transfer their rights under a package travel contract to another person who meets any terms and conditions set for taking part in the trip. The organiser shall be notified of the transfer in a permanent manner no later than seven days before the beginning of the travel. It is possible to submit the notification at a later time, if this does not result in undue difficulties for the organiser. 

The organiser may charge a reasonable fee for the transfer. Kautio Oy collects a €50 service fee for the transfer. 

The transferer and transferee are jointly responsible for paying the price of the trip and the service fee to the organiser.

You can contact the Consumer Disputes Board if you are dissatisfied with the services or error rectification measures provided and you have been unable to resolve your issue despite contacting the package travel retailer directly.

Golf packages at Hotel Levi Panorama, Hotel K5 Levi, and Hotel Matts

The golf package includes accommodation in a Standard or Superior room for one or two persons at either Hotel Levi Panorama, Hotel K5 Levi, or Hotel Matts in Espoo, along with green fees. Additionally, at Hotel Matts, the package includes one night of parking. 

The green fee entitles you to play on the golf course included in the package. The right to play applies to one game per day of accommodation per person during the opening hours of the course in question. 

Requisite minimum number of travellers and repercussions of failing to meet the minimum by the deadline: 

The organiser has not set a requisite minimum number of travellers or deadlines by which a certain number of passengers should be met for the services to be provided. The provision of the package is not dependent on the number of travellers. There is a limited number of packages available for purchase. 

The right of travellers to cancel the contract before the beginning of travel: 

Travellers have the right to cancel the package travel contract at any time before the beginning of the trip. 

The reservation can be changed or cancelled free of charge until 6 pm the night before the date of arrival. If a change or cancellation is made after the deadline but before the beginning of the trip, we will withhold the price of the first day of accommodation as a cancellation fee. Cancellation of the reservation after the deadline must be made in writing to the accommodation’s email address. 

However, the organiser is not entitled to the cancellation fee if the traveller cancels the package travel contract due to such inevitable and extraordinary conditions in the travel destination or its immediate vicinity that substantially affect the transport of travellers to the destination or the arrangement of the travel services in the agreed manner, or if the traveller has some other compelling reason to expect that the organiser’s performance will be significantly deficient. 

Travellers who fail to cancel the trip or arrive at the accommodation location or who do not have valid identification for reasons for which they themselves are responsible are not entitled to reimbursement.

Golf package at K5 Villas  
 
The golf package at K5 Villas includes a minimum of two nights’ accommodation in an 8-person semi-detached house and green fees. 

The green fee entitles you to play at Levi Golf Course. The right to play applies to one round per overnight stay per person during the opening hours of the course.

The organiser has not set a requisite minimum number of travellers or deadlines by which a certain number of passengers should be met for the services to be provided. The provision of the package is not dependent on the number of travellers. There is a limited number of packages available for purchase.

Travellers have the right to cancel the package travel contract at any time before the beginning of the trip.

Yoga/Wellness Packages

The yoga/wellness package includes accommodation in a standard room for one or two persons, meals, and the program as described more precisely in the package description, at specified times and in a specified manner either at Hotel Levi Panorama or Hotel Matts in Espoo. Additionally, parking is included in the package at Hotel Levi Panorama. 

Required minimum number of passengers and consequences if the minimum number of passengers is not met by the deadline: 

If the stated minimum number of participants for the package is not met 14 days before the event, the organizer reserves the right to cancel the event. In this case, payments will be refunded to the customer. Packages are sold subject to availability. 

Passenger’s right to cancel the contract before the start of the journey: 

Passengers have the right to cancel the travel package contract at any time before the start of the journey. 

Reservations can be cancelled free of charge up to 14 days before arrival. If changes or cancellations occur after the specified deadline but before the start of the journey, we reserve the right to charge the price of the first night’s accommodation as a cancellation fee. Cancellation of the reservation after the deadline must be made in writing to the accommodation’s email address. 

However, the organiser is not entitled to the cancellation fee if the traveller cancels the package travel contract due to such inevitable and extraordinary conditions in the travel destination or its immediate vicinity that substantially affect the transport of travellers to the destination or the arrangement of the travel services in the agreed manner, or if the traveller has some other compelling reason to expect that the organiser’s performance will be significantly deficient.
